Dear Sir,
Under the instructions of my client M/s XYZ Company Pvt. Ltd., a company registered under the Companies Act, 2013, having its registered office at…………….. through its director Mr…………….& on being authorised in this behalf, I address you as under; the contents whereof you may be please note-
(1) That you had entered into a contract with my client on………………for the sale & supply of (give the description of goods) goods.
(2) That my client states that my client has paid Rs……………. in advance vide cheque no………… draw on ………….bank dated……………… .However you have supplied only 1/3rd of the agreed quantity of goods.
(3) That the goods supplied by you are sub-standard and not as per thespecification agreed upon mutually vide contract dated ………………. .
(4) That till date you have not supplied the remaining quantity of goods asper the contract inspite of several reminders from my client.
(5) That my client has suffered losses because of breach of contractcommitted by you.
(6) Under the circumstances my client has no alternative but to terminatethe contract with you.
(7) Therefore through this notice the contract between you & my client hereby stands terminated and you are hereby called upon to return the amount of Rs…………..received as an advance payment from my client within eight days from the date of receipt of the notice, failing which my client will be constrained to initiate legal proceedings against you entirely at your risk as to the cost & consequences of any such legal action including the charges of this notice of Rs……………/-
